Private Bookings for Individual Support
At Peak Sleep I want my relationship with you to be as clear, simple and trustworthy as my service, so here, in plain English, are the terms and conditions in which I supply my services to you.
Please read these terms carefully. They tell you who I am, how I will provide services to you, what to do if there is a problem and how the contract between us can change.
Who I am

Peak Sleep is the trading name for a sleep practitioner advice service run by me, Nickie Sutton.
The service I offer you
​
I offer a service that gives you access to advice and support to help improve your own or your child’s sleep via one to one sessions paid for in advance with myself.
​
I use my many years training and experience working in this field to make recommendations on how you might make changes that could lead to better sleep for yourself or your child.
​
Emergencies
I do not provide a crisis or emergency support service. I am not available 24/7
and therefore if you need urgent support please speak to your doctor or nurse or attend an accident and emergency department.

Behaviour
I promise to treat everyone with respect, courtesy and fairness. I expect you to do the same and treat me as you’d like to be treated. You should recognise that inappropriate, abusive or threatening behaviour could result in you being refused access to my services. I reserve the right to remove or deny my services to any individual without explanation.

Who can use Peak Sleep
To use Peak Sleep you must be a UK resident, have an email address, and have access to the internet. Unfortunately I am not insured to work with clients overseas.
My contract with you
When you book an appointment Peak Sleep, you are agreeing to these terms and conditions. For avoidance of doubt, at booking you will be sent a copy of this agreement.

Advice
My services and the content on the website are intended to assist you in your efforts towards understanding sleep better. I am not medically sleep trained and if you have any type of medical or health condition you should seek your professional medical advice before seeking a behavioural approach to improving your sleep or your child’s sleep. Nothing within my services and/or content on the website should be construed as medical advice.

It is up to you if you wish to accept and act on the advice that you are given. Because every family is different, everybody’s situation and circumstances are different, and everybody’s capacity to make changes is different, I accept no responsibility as to the effectiveness, or otherwise, of this advice for you or your child and you are under no obligation to follow the advice.

I am extremely proud of the quality of my work. There can be no guarantee that your sessions will help you achieve your goal, however I will do my very best to help this happen. I have worked with hundreds of families and have had lots of positive feedback but this is not a ‘treatment’ as such with a guaranteed result.

If during the assessment process I feel that there are medical causes for the sleep issue you are experiencing I will advise you to seek a referral to the appropriate medical practitioner.
​
What does it cost?
Clients of Peak Sleep pay in advance for each consultation for the time spent with me and the time taken by me to write a summary of our consultation / devise a sleep plan for you.

Prices for the different levels of support are clearly displayed on the website under the ‘Individual support’ tab in the menu.

Cancellation
It is a requirement of booking my services that I require payment up front for your private consultation, whether booked through the website or directly with me. This is a result of my experiencing late cancellations, no-shows, late arrival at scheduled appointments and non payment after a session by clients in the past.

I also operate a 48-hour cancellation policy. If you cancel an appointment over 48 hours in advance, I will not charge you for the missed session. If you cancel after that, or if you cannot attend, you will still need to pay for the appointment as I have committed the time for you.
Any appointment cancelled or rescheduled without the required 48hrs notice will be charged in full and no refunds given except in exceptional circumstances. I recognise that emergencies happen, even if they are rare. If you know that you might not make an appointment, please let me know as soon as you can. If a genuine emergency prevents you from attending, and also from letting me know, I may consider waiving or reducing the cancellation fee at my own discretion.
Should you repeatedly make and cancel appointments, your fee will not be refunded.
My appointments are conducted online and you will receive a Zoom link when you book. I will open the Zoom call when the session is due to start or slightly before. Please ensure that you have the link ready at the appointment time, and are able to log on. If you do not attend, I will wait for 10 minutes and then send you a reminder text. I will continue to wait for the full appointment time to give you a chance to attend and will then close the Zoom call when the appointment time is over, whether you have arrived or not.
The technology I use for online appointments is very robust and rarely fails. Where it does, I will do my best to offer the appointment using another communication method. Sometimes I may be delayed or miss appointments for reasons I can’t control. If this happens, I will contact you as soon as possible to let you know and I will take steps to minimise the effect of the delay. I will not charge you for appointments I cancel and will do my best to re-book at a time that best suits you. If there is a risk of substantial delay you may contact me to receive a refund for any services you have paid for but not received.

I will not issue any refund if you are not able to use the Zoom platform because of technical issues with your equipment or your internet connection.

Qualifications
Please see my ‘About Me’ page on the website to see my training and experience, both as a formerly registered nurse and specialist sleep practitioner. Although I never work directly individually with children I am DBS checked, ensure I have up to date training and updating, am individually insured (professional liability insurance) and licensed by the Information Commissioner’s Office (ICO) to hold and create client records securely.

Confidentiality
Confidentiality is maintained throughout your appointments. There are limited circumstances in which I have a legal, professional or ethical obligation to provide information to a third party, such as in cases where someone is at risk of being harmed in some way. If you are referred to me by another health professional I will inform them that you are working with me. Any more detailed information would only be shared with your consent.
Privacy & Security
Your privacy and looking after your personal information is very important to me. Any personal information that you provide to me will be dealt with in line with Peak Sleep’s privacy policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us in the event you have a query or complaint about the use of your personal information. Please refer to my Privacy Policy on the website for further details.

Copyright
Everything on Peak Sleep’s website, our handouts and our records (apart from your data) is owned by Peak Sleep. It is protected by copyright. Please do not share, copy distribute or upload any information to a server without permission from me.

Some necessary final details
This contract is between you and me. It is private and no one else has any rights to enforce its terms. I have the right to change or amend the terms of this contract at any time, however I will notify you of such changes as soon as they happen. It is your responsibility to ensure that the email address info@peaksleep.co.uk is added to your ‘safe senders’ list so that you do not miss any important emails from me.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
​
If I do not insist immediately that you do anything you are required to do under these terms, or if I delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent me taking steps against you at a later date. For example, if you miss a payment and I do not chase you, but I continue to provide the services, I can still require you to make the payment at a later date.

These terms are governed by English law and you can bring legal proceedings in the English courts.
If you are ever unhappy or dissatisfied by your experience with Peak Sleep you can always let me know at info@peaksleep.co.uk. If you have a complaint about my support I will do everything I can to not just resolve your issue but to make sure it does not happen again.

If I fail to comply with these terms the maximum amount of my liability will be equal to the consultation fees that you have paid Peak Sleep. I do not, however, exclude or limit my liability to you where it would be unlawful to do so.
